Terms & Conditions

  1. General
    1. The “Terms and conditions” is applicable to all clients audited by Advanced Safety Management Services Pte Ltd (ASMS)
    2. ASMS is a private limited company, financed via paid up shares. ASMS is a Singapore Accreditation Council accredited WSH Auditing Organisation. ASMS offers auditing service within the accredited scope granted (“the Service”). The Services provides an independent audit of an applicant’s workplace safety and health management systems and Risk Management system against a recognized and appropriate criteria/standard.
  2. Request and Application for Auditing Services
    1. Clients can request for the services by sending an email to ASMS to request for an Application Form, or contact us via telephone to speak with our sales/admin representative. Clients will complete the application form with detailed information of the scope of their operations and return it for review on their request for the Services.
    2. If ASMS accepts the request, ASMS will prepare a proposal for client’s acceptance. ASMS reserves the right to decline any request for the Services, stating reason for non-acceptance.
    3. Upon acceptance of the proposal, clients must complete the Auditing Agreement from and return it to ASMS. The Auditing Agreement, together with the proposal upon mutual acceptance by ASMS and clients, serves as a legally binding contractual agreement between ASMS and clients.
  3. ASMS and Responsibilities
    1. ASMS shall be responsible for and shall retain authority for its decision relating to its auditing. ASMS understands the importance of and is committed to impartiality in providing the Services. ASMS shall not allow external pressures to compromise impartiality, and will not market or offer the Services as being linked with the activities of an organization that provides management system consultancy. ASMS will take action to correct inappropriate claims by any consultancy organization stating or implying that audit would be simpler, easier, faster, or less expensive. ASMS will not indicate that audit would be simpler, easier, faster or less expensive if any specified consultancy organization is used.
    2. ASMS audit is based on review and audit of information, documents and samples provided by clients during the performance of the Services. ASMS cannot be held liable for any inaccuracies, omissions or errors in the audit reports and/or any documents issued to clients in the performance of the Services.
    3. Clients to be given all the relevant information on auditing processes and/or requirements and subsequent changes and course of actions.
    4. ASMS shall take appropriate actions with clients to deal with incorrect references to auditing status and/or misleading use of audit documents, marks, score and audit reports. Such actions include request for correction and corrective actions and, if necessary, legal action.
    5. The audit conducted by ASMS does not exempt clients from legal obligations required of the services or products. Client is solely and fully liable for any defects in their services and products and shall protect and indemnify ASMS any and all claims, costs, expenses, loss or damage and liability made by audited clients a a result of their failure to maintain their management system and/or of any negligent act. ASMS shall not be liable for any cost, losses or charges incurred by the clients in the event that the performance of the Services and/or ASMS obligations under the agreement is hindered or is caused to be delayed by any default, act or negligence of the clients.
  4. Clients’ Right & Responsibilities
    1. Clients have the right to object to the inclusion of any auditor proposed by ASMS for the performance of the Services, on the grounds of competency or possible conflicts of interest.
    2. Clients shall, with reasonable diligence, co-operate with ASMS in its provision of the Services by providing access to its premises, personnel, documentation required for the proper conduct of the Services. Clients shall obtain necessary consents to facilitate ASMS auditors’ entry into its premises and to accommodate, where applicable, the presence of observers. Clients shall also ensure a safe and secure working condition on site during the performance of the Services. Clients shall inform ASMS and its auditors of the requirements to comply with any health, safety and security regulations applicable to its premises.
    3. Clients shall pay the fees for the Services invoiced by ASMS in full and promptly on the due date. ASMS may impose an interest charge of 5%, compounded monthly on the sum of outstanding until the payment is made.
    4. Clients shall inform ASMS without delay, of matters that may affect the capability of their management system to continue fulfilling the required standard used for auditing. These changes include, but not limit to :
      • Legal, commercial, financial, organization status or ownership
      • Organisation and management, eg Top Management, decision-marking or project staff
      • Contact address and sites
      • Scope of operations
      • Major changes to the management system and processes
    5. Clients who are audited shall:
      • Not to use or permit the use of audit documents or ASMS mark when making reference to its audit status in any communication media such as in brochures, the internet, advertising and other documents.
      • Give consent for the assessor(s) of accreditation body or/and ASMS trainee auditor to observe any audit if requested upon.
      • Not to make or allow any misleading statements pertaining to audits and do not use or allow the use of audit documents or any part of it in any misleading manner.
      • Not to make reference or implications to activities outside the scope of audit.
      • Not to use auditing activities in any manner that brings ASMS and its auditing system into disrepute and loss of public trust.
    6. Clients shall fully indemnify ASMS against any costs, losses or charges sustained or incurred by the Clients arising from their judgement, decision and/or actions taken on the basis of the information given in the audit report provided by ASMS.
  5. Confidentiality
    1. ASMS to safeguard clients’ information obtained or created during the performance of the Services.
    2. ASMS to inform Clients in advance, of confidential information required to be make available by law and/or governing regulations to third party, e.g. government agencies and accreditation bodies.
  6. Professional Service Fees and Payment
    1. The processional service fees payable for the Services are as follows:
      • Documentation fee, if applicable
      • Auditing fee
    2. The fees payable will be invoiced accordingly and must be paid as invoices.
  7. Audit Process
    1. All audits to be conducted at clients’ premises.
    2. Prior to the audit, the appointment of the auditor(s) will be make know to the clients. Clients have the right to object to the inclusion of any auditor proposed by ASMS on the grounds of competency or possible grounds. Audit objectives shall be determined by ASMS. The audit scope and criteria, including any changes, shall be established by ASMS after discussion with the clients.
    3. Clients to be given an audit plan prior to the audit and the dates of the audit shall be agreed upon in advance with the client.
    4. The audit team to review with the client on any changes to the audit scope which becomes apparent as on-site auditing activities progress. ASMS may amend the agreement with clients if it determines that adjustments to the audit are necessary, e.g. scope, sites, audit man-days and audit fee.
    5. The auditor(s) will prepare an audit report detailing the findings of the audit to the clients’ management after the audit.
    6. Ownership of the audit report shall be maintained by ASMS.
  8. Use of Marks
    1. Clients shall not use or permit the use of ASMS audit report or testimony or the ASMS mark in any communication media such as the internet, brochures and advertisement. Clients shall not use or permit the use of an audit report or testimony or any part thereof in a misleading manner.
    2. Clients shall not make or permit any misleading statement regarding the audit.
  9. Complaints
    1. Clients who may wish to make a complaint could submit in writing to the management of ASMS stating specific details of the nature of the complaint. The management of ASMS will conduct internal investigations and conclusion with corrective actions where deem necessary.
    2. ASMS shall determine, together with the audited client and the complainant, whether and, if so to what extent, the subject of the compliant and its resolution.
  10. Validity of Auditing Agreement
    1. These terms and conditions are valid doe as long as the client remains an audited client with ASMS.
    2. ASMS reserved the right to amend the Auditing Agreement when required and with the mutual agreement of the client.

STATEMENT OF IMPARTIALITY

ASMS top management is committed to safeguard and protect impartiality in all auditing activities. This commitment is communicated that ASMS understands the importance of impartiality in carrying out SAC CT-17 auditing activities. ASMS manages conflict of interest to ensure the objectivity of its SAC CT-17 auditing activities. ASMS deliver SAC CT-17 auditing services with impartiality in mind. ASMS strive to maintain the professionalism and credibility of the audit. It is important to maintain the professionalism and credibility of all the SAC CT-17 Audits in order to deliver confidence and uphold industry standards.

  1. Auditors are prohibited from participating in the Audit of any organization to which they have given assistance, by consultancy or training or where they have any financial or commercial interest for a minimum period of 2 years prior to the date of audit application of the organization. All Auditors shall sign a Subcontractor Agreement and a Non-Disclosure Agreement pertaining to potential conflict of interest.
  2. When allocated to a particular contract, auditors shall not disclose or discuss any details before or after the Audit/ to any member of staff other than their direct Management or other members of the team, as required by the non-Disclosure Agreement signed on commencement of the auditing services.
  3. Auditors are prohibited from engaging in consultancy activities involving in client’s workplace safety and health management system implementation. ASMS shall not suggest or imply to imply that certification would be simpler, easier or less expensive if its services were used. ASMS will also does not state or imply that certification would be simpler, easier, faster or less expensive if any specified consultancy organization were used.
  4. Individuals employed by or otherwise contracted to ASMS are required to document and record their current and past relationships with all relevant clients. Any situation past or present which could arise to potential conflict of interest is to be declared. Information provided shall be used to identify any threats to impartiality.
  5. ASMS only appoint external auditors who are not external auditors of another auditing organization, and shall inform the relevant authorities (Singapore Accreditation Council and Ministry of Manpower) should there be any change of auditor registration.
  6. ASMS ensures that activities of entities, with which the auditing organization or the entities of which it forms a part has relationships, do not compromise the impartiality of its auditing activities.

Auditing Procedure

  • Upon client’s application, review will be carried out. ASMS shall request client for more information if necessary. Examples of information to be gathered are company address, business activities, site addresses, manpower and etc.
  • Upon acceptance, review of documentation will be carried out if applicable.
  • Fist On-site audit to be carried out according to audit plan and relevant regulations.
  • An audit report together with the verified ConSASS checklist to be delivered to client.
  • A testimony will also be issued upon request by client on completion of the Audit.
  • Subsequent to be carried out upon expiry.
